By placing an order with DeltaDIGITAL you confirm that you understand, agree and are bound by the terms and conditions set out below.

The client: The company or individual requesting the services of DeltaDIGITAL
DeltaDIGITAL: The owners, employees or associates of DeltaDIGITAL
Clients: DeltaDIGITAL reserves the right to choose who we accept as a client and may not offer our services to all potential clients where we feel it would not be in the interest of DeltaDIGITAL or appropriate.

DeltaDIGITAL will carry out work when an order has been placed or requested by the client and an agreement has been reached.
An “order” is a written or verbal agreement between the client and DeltaDIGITAL. This includes telephone, email and in person agreements. Updates or additional work requested constitutes a new order.

Cost of services

An estimate or quote for work will usually be given but not restricted to written communication. This may be a verbal quote in some cases and where ongoing work is requested by the client. DeltaDIGITAL will not usually charge more than the estimated cost unless additional work or services is requested by the client beyond the scope of the estimated cost. In which case a quote will be given for additional work either verbally or written.

DeltaDIGITAL do not usually provide credit and only in some circumstances will credit be offered and only when this has been agreed prior to any work or services undertaken. If credit is offered there will usually be a charge for this in the form of interest on the amount of credit given. This would be explained in the agreement you make with DeltaDIGITAL. We take unauthorised credit seriously and may charge late payment fees as well as interest. Credit would be deemed unauthorised if a client on completion or on part completion delayed the launch or handover of a website or services without settling the outstanding account. Or was unable to clear the account balance on completion of the project.

Design / development /media / associated works

Whilst DeltaDIGITAL makes every effort to ensure that the website, programs, applications or scripts that are used have been tested, checked and are error-free, at the time of development, DeltaDIGITAL cannot be held responsible for any losses or damage incurred by malfunction of the website or any part of it. In particular changes in code or programming languages required, browser updates or future issues that arise beyond our control at the time of development. The design of the site, any graphics, programming code, or applications used remain the property of DeltaDIGITAL until all outstanding accounts are paid in full and the website/application/media or associated work is handed over to the client. In some cases, the programming code or applications used may remain the property of DeltaDIGITAL unless a prior agreement has been made.

DeltaDIGITAL will provide provisional graphics for the client to view and approve where appropriate. Changes may be made within reason at this stage without cost. However once approved and the product is developed or created, changes made to the design, structure, workings or additional work that is requested may incur further charges. DeltaDIGITAL will inform or provide a quote to the client prior to any charges being applied to the account.

Schedule of work and timescales

DeltaDIGITAL will provide the client with an estimated timescale and inform the client when the project will be scheduled. DeltaDIGITAL will normally require some notice to schedule work in and this timescale may vary. Whilst every effort is made to complete projects within the timescale given this may not always be possible. The client understands that timescales may vary dependant on whether DeltaDIGITAL has all the information provided by the client when requested and when the client approves work. Other factors beyond the control of DeltaDIGITAL may affect the timescale. If work has been scheduled in and this changes for any reason or the client wishes or needs to delay the project or does not have the information required, then the project will need to be re-scheduled in.

Search engine friendly

The term search engine friendly means that the website is coded in such a way that it will be recognised by and submitted to the major search engines, that all the appropriate page titles, meta tags, alt tags and meta keywords are placed in the site. This does not guarantee a high ranking within the search engines for search terms other than the domain name. However, DeltaDIGITAL does provide search engine optimisation services for additional cost unless otherwise agreed in the quote or estimate.

Content management Systems

Where the site owner has the facility to manage the content of the website, upload images and change the content and structure of the site, Delta DIGITAL will not be held responsible or liable for any content added or the use of content and its legality. Likewise, any plugins, software or scripts added should be verified as safe and fit for purpose. We will not take responsibility for any malicious code effecting the website or product and unauthorised access to the system.
Whilst every effort is made to provide training on the use of content management systems, DeltaDIGITAL cannot be held responsible or liable for any loss or damage to the site, its contents or structure. In the unlikely event that loss or damage occurs due to site owner error DeltaDIGITAL will endeavour to correct the issue, however a charge may be applied the account. DeltaDIGITAL will provide up to two hours free training on the use of the content management system at the DeltaDIGITAL office. If additional training or training of other members of the company staff or individuals is required, then charges may be applied to the account.

The client agrees to make available and provide any material needed to complete the project in a timely and accurate manner. DeltaDIGITAL will not be held responsible for any losses, cost involved or compensation due to failure to meet deadlines.
DeltaDIGITAL will not be liable or become involved in any disputes between the site owner and their clients or customers and cannot be held responsible for any wrongdoing on the site owner’s part. Whilst every effort is made to ensure the availability of the website emails or functions of the website, DeltaDIGITAL cannot be held responsible or liable for any costs incurred, loss of earnings or compensation due to unavailability and reasons beyond the control of DeltaDIGITAL.

Whilst every effort is made to ensure compatibility and correct functioning of the site at the time of the website build, DeltaDIGITAL cannot be held responsible or predict for incompatibility arising in the future caused by browser updates, programming code updates or government legislation. Whilst any issues or errors will be corrected on request by the client the client understands that there may be a cost and timescale involved. DeltaDIGITAL will inform the client prior to any work being carried out of any cost.

DeltaDIGITAL provide hosting services through third party vendors.
Data is stored electronically on our private servers in Secure UK datacentres covered by ISO 27001 and is exclusive to clients of DeltaDIGITAL.
We provide multiple hard drives and servers to protect against hardware failure and have data backup and disaster recovery procedures to protect against data loss.
We take every reasonable step to ensure the availability of hosting services. We expect to experience 90 — 100% uptime, however there may be occasions when reasons beyond the normal operating environment affect services. These can be software or hardware related issues. These issues are usually dealt with in a matter of hours. Other issues such as network access to the data centre or in a worst case a complete power outage lasting beyond backup systems may affect hosting services. We are pleased to say that these more significant issues are extremely rare.

Although every effort is made to ensure the correct functioning and availability of these hosting services including email hosting. DeltaDIGITAL cannot be held responsible or liable for any loss incurred due to unavailability or incorrect functioning.
It is the responsibility for clients having hosting accounts including email hosting to ensure that the devices used to connect to servers are virus and malware free. That any content uploaded to the server is scanned by an up to date antivirus program prior to uploading.
Any account that is found to be infected, transmitting malicious code, viruses, malware or acting in any way that may harm the running of our servers or the security and safety of other accounts will be immediately suspended until further investigation has take place. These accounts may be terminated without notice. Likewise any accounts found to be sending mass or spam email will be subject to the same procedure.
It is also the responsibility of the account holder to ensure the use of strong passwords and to take all reasonable steps to guard against unauthorised access.
Please see our Data Protection Policy for what steps we take to protect the safety of our clients. We cannot be held responsible for Data breaches beyond the control of our systems.

Hosting is subject to a 12-month contract. Hosting is non-refundable excluding a 14 day period when ordering online. Hosting is usually paid annually but can be paid monthly on a subscription basis. Approximately 2 weeks before your hosting is due for renewal you will receive a reminder to your registered email address. You will also receive further reminders before the due date. You should pay on or before the due date. We allow a 7 day grace period after the due date. Failure to pay within these timescales will lead to account suspension and ultimately termination.

We take security very seriously. We have several systems in place to protect against unauthorised access. Please see our Data Protection Policy.
It is the responsibility for account holders to take reasonable steps to guard against unauthorised access. Such as using strong passwords and storing these safely. Not giving those passwords to anyone else and using up to date antivirus programs on devices with regular scans.
We will not take responsibility for unauthorised access beyond the control of our systems.
Should you suspect a breach of security you should change your passwords and notify us immediately.

Technical support

DeltaDIGITAL does not provide technical support beyond the scope of the website or offer any advice relating to the client’s ability to access the website. For example, if the client is experiencing difficulty viewing the website due to internet service provider issues, computer issues or any other issue not relating directly to the website. DeltaDIGITAL will check that the website is generally available and that there are no known issues but cannot help beyond this. Customer service is available Monday to Friday between the hours of 9-5
A support ticket system is available 24 hours a day seven days a week (excluding public holidays) and will be responded to on a priority basis. However emergency out of hours during public holidays will be available via support ticket.

DeltaDIGITAL will set up email accounts on the server and provide a webmail login and details of the account(s) including server settings to the client. Domain names

DeltaDIGITAL provide domain name registration services though third-party vendors and cannot be held responsible for any loss incurred due to unavailability or incorrect functioning.

A non-refundable deposit will usually be requested on order of work or services and must be paid within seven days of the order unless otherwise agreed. The amount of deposit may vary depending on the size and nature of the project and this will be set out in the agreement between the client and DeltaDIGITAL. When ordering online the customer has 14 days to ask for a full refund however work will not begin until this 14 days has passed unless the customer is sure and waives this right in which case we will commence work as soon as possible on the basis the customer understands that the deposit will be non refundable.
Invoices for work carried out must be paid within seven days unless otherwise agreed.
We do offer payment options whereby a customer may choose to pay for the services over a period of months. Such as ordering a new website. The customer is required to pay the full original cost of the website once built. As such cancellation of the subscription until the full balance has been paid would trigger an invoice for the full amount of the balance on the original agreement. The customer is liable for the full amount.

Cancellation of services

Once an agreement has been made between DeltaDIGITAL and the client DeltaDIGITAL reserves the right to request the remaining balance to be paid in full. In the event of cancellation of services depending on what stage the project is in for example if the website is complete and built then DeltaDIGITAL may ask for the balance to be paid in full to cover costs (unless otherwise agreed).

Late payments

If late payments reminders are issued, then a charge may be applied to the clients account. If the account is not settled within seven days of the reminder, then interest may also be applied to the account unless otherwise agreed with good reason.
If the account is not settled after these seven days, then DeltaDIGITAL may pass the matter on to our company solicitor for consideration.

Complaints procedure

In the unlikely event that the client has cause for complaint the client may email outlining the cause for the complaint to us and the matter will be closely examined and decided whether there are grounds for complaint. DeltaDIGITAL will endeavour to correct any grounds for complaint within thirty days of receipt where possible and appropriate.

DeltaDIGITAL expects clients to show due respect and courtesy when communicating with members of staff at DeltaDIGITAL and to be polite at all times. Clients can expect the same from members of staff.
